Similarly, I have done a whole series of articles which I like to call” From Colossus (or CPEC) to the Courtroom”. In these articles I first focus on the courtroom, which only occurs rarely but very important for attorneys to set up cases “as if” they would go to trial. After this article I talk about the 99% of the rest of the cases which do not go to trial that are dictated by Colossus or CPEC (Computer Programs to Evaluate Claims), which are software programs designed by the insurance companies to evaluate and in most cases reduce the settlement based on your demands. According to multiple sources, these software programs utilized by insurance carriers are based on four main categories and percentages as follows:

  1. 25%-neurological damage
  2. 25%-whole person impairment
  3. 25%-duties under duress (functional loss)
  4. 25% loss of enjoyment of life (functional loss)

Workers Compensation Attorneys

Dr. Muldavin has treated injured workers since 1988 and became a Qualified Medical Evaluator in 1992 at the genesis of this program. Dr. Muldavin has performed hundreds of qualified medical evaluations and most recently the new laws allow primary treating physicians to perform medical legal evaluations which have the same weight as a QME and or an AME. I have many attorneys who refer patients for me to act as their clients Primary Treating Physician who many times have been treated prior to Dr. Muldavin seeing the patient. Many times, they have come from different clinics or hospitals who act as the first contact for the injured worker directed by the employer and many times the medical records do not include certain body parts or many other medical legal issues. What many workers compensation attorneys do not realize is that as a primary treating physician we can perform medical legal evaluations if there's any medically legal contested issues such as accepted body parts, total temporary disability, or AOE/COE issues. With my expertise as a QME’s I can perform primary treating physician medical legal evaluations with Substantial Medical Evidence proving your client/ injured worker perhaps does have injuries to the non-accepted body part and should be on Total Temporary Disability and by describing the mechanism of injury, Dr.Muldavin can within a Reasonable Medical Probability substantiate the cause of the injuries if indicated.
